Welcome to the Dr. Birdy Books (DBB) worksheet website. These terms outline the rules and conditions that govern your access to and use of the DBB platform (the “Site”).

If you do not agree with any part of these terms, please do not access or use the Site or any materials it contains. By continuing to use the Site, you confirm your acceptance of these terms.

Your interaction with our Site is governed by our Privacy Policy, which is incorporated into these terms by reference. You can view our Privacy Policy here. Please read it carefully.

By registering on our Site, you agree to the transfer and storage of your personal information in countries outside your home country, including the United States. Your personal data will be processed according to our Privacy Policy.

User Accounts and Subscriptions

To access certain areas of the Site you may require a password, thus you must create an account.

You are responsible for complying with these Terms of Use while using the Site. It is your duty to keep your password and account details confidential, and you are fully accountable for all actions taken under your account. You must promptly notify DBB of any unauthorized access or security breaches. DBB is not liable for any unauthorized access resulting from your actions.

Individual accounts are intended for personal or family use only. If we suspect that an account is being shared among multiple users, we reserve the right to suspend your account.

Subscriptions are personal and non-transferable. Accounts may not be shared among multiple individuals or organizations unless explicitly permitted by DBB. School accounts may be shared among teachers within the purchasing institution.

You agree to pay all fees associated with your use of the Site. Fees are determined by the purchase made. We may suspend or terminate your account and/or access to our content if your payment method cannot be processed. By providing a payment method, you authorize us to charge applicable fees, including any taxes and additional charges related to your account.

Payments (Individual Accounts Only)

By providing your payment information, you authorize DBB and/or our third-party payment processor to charge the applicable fees and any associated taxes or charges.

Account Data

Once an account is terminated, the account holder may lose access to their account and its contents. It is the account holder’s responsibility to save any necessary information before the account is closed. Upon termination, we may delete all associated data in accordance with this Agreement and the Privacy Policy.

Price Changes

We reserve the right to adjust pricing at any time at our discretion. We do not offer price protection or refunds in the event of promotions or price reductions.

Use of Copyrighted Materials and Trademarks

All content on the Site, including worksheets, workbooks, ebooks, documentation, text, data, graphics, images, software, interfaces, and other works (collectively referred to as the “Materials”) are protected by copyright and are either owned or licensed by DBB. All rights are reserved. The Materials may also contain trademarks and service marks owned by DBB and its affiliates, as well as third-party trademarks.

Worksheets

You are permitted to view and print our worksheets for personal, non-commercial purposes only. Teachers and tutors may print and use copies of worksheets for classroom or tutoring purposes but are prohibited from reselling or redistributing them. Any other use of our worksheets, including reproduction for unauthorized purposes, modification, distribution, or republication, without prior written consent from DBB, is strictly forbidden.

General Provisions

Except as expressly permitted by us or in these Terms, you may not copy, reproduce, publish, perform, distribute, modify, create derivative works of, rent, lease, sell, assign, sublicense, or otherwise exploit the Materials in whole or in part for commercial purposes. You may not, without our prior written consent, decompile, disassemble, reverse engineer, or attempt to discover the source code of the software or any other content on the Site. Storing significant portions of any content in any form is prohibited. Unauthorized use of the Site or Materials may result in civil liability and criminal prosecution.

Automated scraping, harvesting, indexing, mining, or any other extraction of content from the Site is expressly forbidden.

Any products, processes, or technologies described in the Materials or offered for sale through the Site may be subject to other intellectual property rights reserved by DBB, its affiliates, or third parties. Nothing on the Site shall be interpreted as granting any license or right under any copyright, trade secret, patent, trademark, or other intellectual property rights of DBB, its affiliates, or any third party. All such rights in the Materials are expressly reserved.

DBB reserves the right to terminate the account of any individual, group, token holder, or organization without refund if it is determined that they have violated this section of the Agreement.

Links to Our Site

You may link to pages on this Site; however, direct links to individual worksheets (e.g., PDF files) are not permitted. Framing techniques that enclose any DBB trademark, logo, trade name, or proprietary information without our express written consent are prohibited.

Links to External Websites

The Site may contain links to third-party websites that are not affiliated with, controlled by, or maintained by DBB. If you choose to use these links, you will leave the Site. DBB has not reviewed all of these third-party sites and is not responsible for their content. DBB does not endorse or make representations about third-party sites or any information, software, or other products found there. Accessing any linked third-party site is done at your own risk.

Password-Protected Areas

Certain sections of the Site may be restricted to registered users (“Password-Protected Areas”). If you have registered as an authorized user, you are entirely responsible for maintaining the confidentiality of your password and agree to notify DBB if your password is lost, stolen, disclosed, or compromised. You are also responsible for all activities that occur under your account. You must immediately inform DBB of any unauthorized use of your account or any other security breaches.

User Submissions

You acknowledge that you are responsible for any information or materials you submit to the Site via email or other means (each a “Submission”). You, and not DBB, bear full responsibility for your Submissions, including their legality and originality. You agree to indemnify DBB against any costs, damages, liabilities, and expenses arising from a third-party claim related to your Submissions or your use of the Site.

DBB reserves the right to review and remove any Submission that it deems inappropriate or that violates these Terms of Use.

Any material, information, or ideas you transmit to or post on the Site will be treated as non-confidential and non-proprietary and may be used by DBB for any purpose, including product development and marketing. All personal data provided to DBB will be handled in accordance with the DBB Privacy Policy.

User Conduct

You agree not to upload, distribute, or publish any content on the Site that you do not have the right to transmit or that is defamatory, obscene, threatening, invasive of privacy, abusive, illegal, or otherwise objectionable. You will not interfere with others’ ability to access or use the Site or disrupt the normal flow of communication. If you access our system improperly or allow others to do so, you will be liable for the cost of the content that has been violated, plus any associated costs incurred by DBB in investigating your actions.

Improper access includes circumventing our registration or payment systems, hacking, sharing account information, or using multiple email accounts to avoid payment.

Modifications to the Service

We may change, add, or remove features, pricing, and other aspects of the Site at any time. These Terms will continue to apply to the modified Site. We reserve the right to temporarily or permanently modify or discontinue the Site, with or without notice. You agree that we will not be liable to you or any third party for any modifications, suspensions, or discontinuations of the Site.

Termination

DBB reserves the right to terminate your password, account, and access to the Site at its discretion for any reason, including inactivity or violation of these Terms. We may also modify or discontinue providing the Site or any part thereof at any time. You acknowledge that DBB may deactivate or delete your account and all related information without prior notice.

Disclaimer of Warranties

THE CONTENT, THE SITE, THE SERVICES, AND EACH COMPONENT THEREOF ARE PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES REGARDING THE SITE, CONTENT, AND SERVICES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT GUARANTEE OR MAKE ANY REPRESENTATIONS REGARDING THE USE, VALIDITY, ACCURACY, OR RELIABILITY OF THE COMPANY CONTENT OR ANY THIRD-PARTY SITES.

UNDER NO CIRCUMSTANCES SHALL WE OR ANY THIRD PARTIES BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF YOUR USE OR INABILITY TO USE THE COMPANY CONTENT, THE SITE, OR ANY PORTION THEREOF, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IF YOUR USE OF THE SITE RESULTS IN THE NEED FOR SERVICING OR REPAIR OF EQUIPMENT OR DATA, YOU ASSUME ALL COSTS.

Limitation of Liability

DBB will not be liable for any damages related to your inability to use the service and the Site or any content on the Site. In no event will DBB be liable for any indirect, consequential, exemplary, punitive, special, or incidental damages, including but not limited to personal injury claims, loss of data, revenue, profits, or other economic advantages. Notwithstanding the above, DBB’s total liability for damages under this Agreement will not exceed one hundred dollars ($100.00).

Revisions to this Agreement

You agree that DBB may revise these Terms at any time without notice by updating this document on the Site. Your continued use of the Site after such modifications constitutes your acceptance of the revised Terms.

To report a claimed copyright infringement, please contact DBB on the Site via our Contact Us form. If you believe that any Material has been copied in a way that constitutes copyright infringement, please provide the following information:

1. An electronic or physical signature of the person authorized to act on behalf of the copyright owner;

2. A description of the copyrighted work you claim has been infringed;

3. A description of the location of the allegedly infringing Material on the Site;

4. Your name, address, telephone number, and email address; and

5. A statement regarding why you believe in good faith that the use of the copyrighted material is not authorized.

General Provisions

This Agreement is governed by the laws of the Province of British Columbia. Each party submits to the exclusive jurisdiction of the courts in Vancouver, British Columbia. If DBB prevails in any action to enforce this Agreement, it will be entitled to recover costs and attorney fees.

These Terms and any applicable policies posted on the Site represent the entire agreement between the parties regarding the subject matter. All rights not expressly granted are reserved. If any provision of these Terms is found to be illegal or unenforceable, the remaining provisions will remain in effect.
